Privacy Policy

This privacy policy (the "Policy") describes how the Personal Information (as defined herein) that the User may provide in the "Boom Health" mobile application (the "Mobile Application”), operated by BOOM HEALTH LLC (“Boom Health”) and any of its related products and services (collectively, "Services") is collected, protected and used. It also describes the choices available to the User regarding Boom Health’s use of the User’s Personal Information and how the User can access and update this information. This Policy is a legally binding agreement between the User, as a user of the Mobile Application (the "User") and Boom Health, as the Mobile Application developer. By accessing and using the Mobile Application and Services, the User acknowledges that the User has read, understood, and agrees to be bound by the terms of this Policy. This Policy does not apply to the practices of companies that Boom Health does not own or control, or to individuals that Boom Health does not employ or manage, or to any third-party websites or applications that the User may access via our Mobile Application and/or Services.

Automatic collection of information

When the User uses the Mobile Application, Boom Health’s servers automatically record information that the User’s device sends including but not limited to, the User’s device's IP address and location, device name and version, operating system type and version, language preferences, information the User searches for in the Mobile Application, access times and dates, and other statistics.

Information collected is used only to identify potential cases of abuse and establish statistical information regarding the usage of the Mobile Application and Services. This statistical information is not otherwise aggregated in such a way that would identify any particular user of the Mobile Application.

Collection of personal information

The general use of the Mobile Application and Services does not require the User to divulge any Personal Information or any other identifying information and data. Some features of the Mobile Application and Services such as creating an account or publishing, however, may request certain Personal Information, which Boom Health will receive and store. When required, this Personal Information may include but is not limited to:

  • Personal details such as name, country of residence, etc.;
  • Contact information such as email address, address, etc.;
  • Account details such as user name, unique user ID, password, etc.;
  • Geolocation data such as latitude and longitude.;
  • Certain features on the mobile device such as contacts, calendar, gallery, etc.;
  • Information about other individuals such as your family members, friends, etc.;
  • Any other materials you willingly submit to us such as articles, images, feedback, etc.; and
  • Debit/credit card numbers (collectively, the “Personal Information”).

The User is not required to provide Boom Health with his/her/their Personal Information. Should the User choose to not share his/her/their Personal Information with Boom Health, the User may be unable to use certain features of the Mobile Application. Users who are uncertain about what information is mandatory are welcome to contact Boom Health.

Any of the information we collect from the User may be used for the following purposes:

  • Create and manage user accounts;
  • Send administrative information;
  • Respond to inquiries and offer support;
  • Request user feedback;
  • Improve user experience;
  • Enforce terms and conditions and policies;
  • Protect from abuse and malicious users;
  • Respond to legal requests and prevent harm; and
  • Run and operate the Mobile Application and Services.

Use and Processing of Personal Information

In order to make the Mobile Application and Services available to the User, or pursuant to various legal obligations, Boom Health must collect and use certain Personal Information. If the User does not provide the information that Boom Health requests, Boom Health may not be able to provide the User with the requested products or services.

Processing the User’s Personal Information depends on how the User interacts with the Mobile Application and Services, where the User is located in the world and if one of the following applies: (i) the User has given its consent for one or more specific purposes; (ii) provision of Personal Information is necessary for the performance of an agreement with the User and/or for any pre-contractual obligations thereof; (iii) processing is necessary for compliance with a legal obligation to which the User is subject to; (iv) processing is related to a task that is carried out in the public interest or in the exercise of official authority vested in Boom Health; (v) processing is necessary for the purposes of the legitimate interests pursued by Boom Health or by a third party.

Note that under some legislations Boom Health may be allowed to process the Personal Information of the User until the User opts out of processing, without having to rely on consent or any other of the following legal bases below. In any case, Boom Health will be happy to clarify the specific legal basis that applies to the processing, and in particular whether the provision of Personal Information is a statutory or contractual requirement, or a requirement necessary to enter into a contract.

Managing Information

YThe User is entitled to delete certain Personal Information contained/entered in the Mobile Application, though the Personal Information the User is entitled to delete may change as the Mobile Application and Services change. Boom Health may maintain a copy of the unrevised Personal Information for the time period reasonably necessary to comply with any obligations to its affiliates and partners, and for the purposes described below. If the User would like to delete his/her/their Personal Information or permanently delete his/her/their account, the User may do so by contacting Boom Health.

Disclosure of information

Boom Health may share the User’s Personal Information, with his/her/their consent, to trusted third parties and/or any other affiliates and subsidiaries (collectively “Third Parties”) in order to complete a transaction or to adequately provide the requested services. For greater certainty, the Third Parties are not authorized to use or disclose the Personal Information for their own marketing or other purposes. Boom Health does not share Personal Information with unaffiliated third parties. These service providers are not authorized to use or disclose the User’s Personal Information except as necessary to perform services on Boom Health’s behalf or to comply with legal requirements.

Boom Health shall disclose any Personal Information it collects, uses or receives if required or permitted by law, such as to comply with a subpoena, or similar legal process, and when Boom Health believe in good faith that disclosure is necessary to protect its rights, protect the User’s safety or the safety of others, investigate fraud, or respond to a government request.

Retention of information

Boom Health will retain and use the User’s Personal Information for the period reasonably necessary to comply with its legal obligations, resolve disputes, and enforce its agreements, unless a longer retention period is required or permitted by law (the “Retention Period”). Boom Health may use any aggregated data derived from or incorporating the User’s Personal Information after the User updates or deletes it, but not in a manner that would identify the User personally. Once the Retention Period expires, the Personal Information shall be deleted. Therefore, the right to access, the right to erasure, the right to rectification and the right to data portability cannot be enforced after the expiration of the Retention Period.

The Rights of Users

The User may exercise certain rights regarding his/her/their Personal Information processed by Boom Health. In particular, the User has the right to do the following: (i) to withdraw prior consent to the processing of the User’s Personal Information; (ii) to object to the processing of the User’s Personal Information if the processing is carried out on a legal basis other than consent; (iii) to learn if Personal Information is being processed by Boom Health, obtain disclosure regarding certain aspects of the processing and obtain a copy of the Personal Information undergoing processing; (iv) to verify the accuracy of the User’s Personal Information and ask for it to be updated or corrected; (v) under certain circumstances, to restrict the processing of the User’s Personal Information, in which case, Boom Health will not process the User’s Personal Information for any purpose other than storing it; (vi) under certain circumstances, to obtain the erasure of the User’s Personal Information; (vii) to receive the User’s Personal Information in a structured, commonly used and machine readable format and, if technically feasible, to have it transmitted to another controller without any hindrance. This provision is applicable provided that the User’s Personal Information is processed by automated means and that the processing is based on the User’s consent, on a contract which the User is part of or on pre-contractual obligations thereof.

Privacy of children

Boom Health does not knowingly collect any Personal Information from children under the age of 18. If the User is under the age of 18, Boom Health kindly requests that the User does not submit any Personal Information through the Mobile Application and/or Services. Boom Health encourages parents and legal guardians to monitor their children's internet usage and to help enforce this Policy by instructing their children never to provide Personal Information through the Mobile Application and Services without their permission. If the User has reason to believe that a child under the age of 18 has provided Personal Information through the Mobile Application and Services, please contact Boom Health. The User must also be old enough to consent to the processing of his/her/their Personal Information in the User’s country (in some countries Boom Health may allow the User’s parent or guardian to do so on the User’s behalf).

Links to other resources

The Mobile Application and Services contain links to other resources that are not owned or controlled by Boom Health. Please be aware that Boom Health is not responsible for the privacy practices of such other resources or Third Parties. Boom Health encourages the User to be aware and cautious when the User leaves the Mobile Application and Services and to read the privacy statements of each and every resource that may collect Personal Information.

All statements and/or opinions expressed in any such Third Parties content, other than the content provided by Boom Health, are solely the opinions and the responsibility of the person or entity providing those materials. Such materials do not necessarily reflect Boom Health’s opinion. Boom Health is not responsible, or liable to the user or any Third Parties, for the content or accuracy of any Third-Parties materials.

Information security

Boom Health aims to protect the User’s Personal Information through a system of organizational and technical security measures. Boom Health has implemented appropriate and reasonable technical and organizational security measures designed to protect the security of any Personal Information Boom Health processes. However, despite Boom Health’s safeguards and reasonable efforts to secure the User’s Personal Information, no electronic transmission over the Internet or information storage technology can be guaranteed to be 100% secure. As such, Boom Health cannot promise or guarantee that hackers, cybercriminals, or other unauthorized Third Parties will not be able to defeat our security and improperly collect, access, steal, or modify the User’s Personal Information. Although Boom Health will do its best to protect the User’s Personal Information, transmission of Personal Information to and from Boom Health’s Services is at the User’s own risk. The User should only access the Services within a secure environment.

Data breach

In the event Boom Health becomes aware that the security of the Mobile Application and Services has been compromised or the User’s Personal Information has been disclosed to unrelated Third Parties as a result of external activity, including, but not limited to, security attacks or fraud (a “Data Breach”), Boom Health reserves the right to take reasonably appropriate measures, including, but not limited to, investigation and reporting, as well as notification to and cooperation with law enforcement authorities. In the event of a Data Breach which Boom Health is or becomes aware of, Boom Health will make all reasonable efforts to notify affected individuals if Boom Health believes that there is a reasonable risk of harm to the User as a result of the Data Breach or if notice is otherwise required by law. In the event of a Data Breach, Boom Health shall notify any and all affected parties by email.

Use of Cookies

Boom Health uses cookies and similar technologies (collectively “Cookies”) when the User uses Boom Health’s Mobile Application and services.

Cookies help Boom Health make its Services more reliable, secure, and user-friendly by analyzing the usage of the Services. This analysis allows Boom Health to provide its users with a more personalized experience.

There are certain Cookies that are essential for the operation of Boom Health’s Services and to enable the User to move around these Services and use their features. These Cookies are always active and cannot be turned off or opted out of. The User may set his/her/their device to block or alert him/her/them about these Cookies, which may disable some parts of Boom Health’s Services. For example, Cookies help store the contents of the User’s shopping cart, maintain security on Boom Health’s Services and similar functionality. The User can withdraw his/her/their consent or modify his/her/their cookie preferences at any time by clicking on the ‘Cookie Settings’ link on Mobile Application. Please note that without some Cookies, certain features of the Mobile Application may not work properly.

Before Boom Health places any Cookies on the Mobile Application which are not strictly necessary for the Services, Boom Health will present the User with a Cookie acceptance center, whereby Boom Health will seek the User’s consent to the placing of such Cookies, consistent with local law requirements.

Changes and amendments to this Policy

Boom Health reserves the right to modify this Policy or its terms relating to the Mobile Application and Services from time to time in its sole discretion and will notify the User of any material changes to the way in which Boom Health treats Personal Information. Boom Health may also provide notice to the User in other ways subject to Boom Health’s discretion, such as through the contact information the User has provided. Any updated version of this Policy will be effective immediately upon the posting of the revised Policy unless otherwise specified. The User’s continued use of the Mobile Application and Services after the effective date of the revised Policy (or such other act specified at that time) will constitute the User’s consent to those changes. However, Boom Health will not, without the User’s consent, use the Personal Information in a manner materially different than what was stated at the time the Personal Information was collected.

Acceptance of this policy

The User acknowledges that he/she/they have read this Policy and agree to all its terms and conditions. By accessing and using the Mobile Application and Services the User agrees to be bound by this Policy. If the User does not agree to abide by the terms of this Policy, the User shall not be authorized to access or use the Mobile Application and Services.
